SlotsMagic is operating as part of the open and regulated internet gaming (igaming) market in Ontario conducted and managed by iGaming Ontario (iGO) and is collecting, using and disclosing personal information on behalf of, and as agent to, iGO. iGO asserts the legal authority to collect personal information under the “Freedom of Information and Protection of Privacy Act” (FIPPA) (Ontario), “Personal Information Protection and Electronic Documents Act” (PIPEDA) (Canada), and O. Reg. 722/21: LOTTERY SUBSIDIARY - IGAMING ONTARIO made under the “Alcohol and Gaming Commission of Ontario Act”, 2019 (AGCO) (Ontario). We also collect your information in accordance with IGO’s contractual and operational requirements (hereinafter called “Privacy Laws and Regulations”).

Our Privacy Policy and all related matters are solely governed by the laws of Ontario and the applicable federal laws of Canada.

Purpose of this Policy

The Types of Information We Collect

We collect two types of data and information from our customers.

Personal Information

Personal is the information which can be used to identify directly or indirectly an individual. The personal information we collect through our services includes information, which is submitted directly by you, such as: phone number; full name; e-mail address; home address; date of birth; payment means (e.g. card number); and other financial information that we may need to provide you with our services. We also collect Personal Information from your device (e.g. geolocation data, IP address), information on your activity on the services we provide you with (e.g. pages viewed, online browsing, clicks, scroll, actions/ game searches, etc.) and any other personal information which you may provide to us for the purpose of receiving our services.

We may also obtain information about you by collecting it from the interaction patterns carried out on our website (i.e., use of cookies), to improve the experience of using our website and ensure its proper functioning. Non-personal Information

The second type of information is unidentified and non-identifiable information pertaining to you which may be made available or gathered via your use of the services. We are not aware of the identity of the user from which Non-personal Information was collected. Non-personal Information which is being collected may include your aggregated usage information and technical information transmitted by your device, including certain software and hardware information (i.e., the type of browser and operating system your device uses, language preference, access time and the domain name of the website from which you linked to our services etc.), in order to enhance the functionality of our services.

If we combine Personal Information with Non-personal Information, the combined information will be treated as Personal Information for as long as it remains combined. For the avoidance of doubt, if there is a possibility that information can be linked to an identifiable account, it will be treated as Personal Information.

How We Collect Your Information

Collecting Information about you, from you

SlotsMagic collects personal information about you whenever you use our services. Some of it you provide it directly to us, for example, when you register an account or fund your account. Other information is collected during your interactions with us, such as the bets you place or online chats with our customer services team. Also, if you consent, we will record all telephone conversations and collect your information to send you marketing material. We also collect information about the way you access, view, share, contribute to and communicate with and through our services, for example when you post comments via our social media channels or chat functionalities.

Collecting Information about you, from your device

We collect information from the devices you use when using SlotsMagic content, products and services. This includes but is not limited to the following: your IP address (a number that identifies a specific device on the internet and is required for your device to communicate with websites), hardware model, operating system and version number.

Collecting Information about you, from the mobile application you use

We may collect information about you from the mobile application you use, upon the application’s installation and at the first time of opening it. This information may include your IP Address, and your address-related data obtained from the IP Address, such as your country code, state, city and postal code. We may also collect your device information, such as your platform – iOS or Android – your phone OS and application version. We can also collect your advertising ID if you specifically provide your consent to it. Your personal information is also collected when creating an account with us and registering to receive our services. This information is required for account creation, security verification, regulatory compliance and to enhance your overall experience with the application.

Collecting Information about you, from your computer and through Cookies

We may collect information about your computer, including where available your IP address, operating system and browser type, for system administration and to report aggregate information to our advertisers. This is statistical data about our users’ browsing actions and patterns and does not identify any individual.

For the same reason, we may obtain information about your general internet usage by using a cookie file which is stored on your browser or the hard drive of your computer. Cookies contain information that is transferred to your computer’s hard drive. They help us to improve our site and to deliver a better and more personalized service to you. Collecting Information about you, from external companies

To help us comply with our legal and regulatory KYC and Social Responsibility obligations:

When you open your account, we will cross-check/ reference the information you supplied to us with external/governmental companies for Anti-Money Laundering and identity verification processes, as well as to ascertain whether you are registered with them because you asked not to be allowed to gamble or receive marketing. Electronic Know Your Client (“EKYC”) or automatic verification solutions provided by third party providers can be used to ascertain a player's identity in accordance with the Financial Transactions and Reports Analysis Centre of Canada (FINTRAC) requirements. For these third parties, we ensure that they adhere to the same laws, regulations and standards as we do.
We use publicly available information (on social media sites and the like) to help verify the information provided to us and we log and save the results.

Collecting personal data from a third party as part of a business or asset transfer:

We may also collect personal data about you from third parties from time to time. For example, if you are a former customer of a SlotsMagic partner and your data was passed to SlotsMagic we will have acquired the following categories of your personal data from your previous online betting and gaming provider in order to integrate your former account into SlotsMagic’s platforms and systems, and to provide our gambling services to you in accordance with our Terms and Conditions. Copies of your existing KYC, identification and Enhance Customer Due Diligence documents originally supplied to your former provider – where we can, we will process these documents to allow you to access SlotsMagic services without have to ask you to supply updated documents.
If you are a ‘time out’ or ‘self-excluded’ customer, your account status and duration
of any relevant live time out or exclusion period.

We also collect, use and disclose your personal information in accordance with the following provisions of FIPPA:

Collection of data: under section 38(2) of FIPPA, we collect information that is necessary for the proper administration of a lawfully authorized activity – to provide you with the internet gaming services under the Gaming Control Act, 1992 and our agreement with IGO.
User of data: under section 41(1) of FIPPA, we use your personal information only for the purposes for which it was collected, such as verifying your identity, ensuring responsible gaming, fraud detection and prevention etc.
Disclosure of data: under section 42(1) of FIPPA, we may disclose your information after obtaining your consent, if it is necessary based on the purpose for which it was collected and where disclosure is required or authorized by law, as per the IGO, AGCO or other law enforcement.

Where the data processing is in accordance with your consent, you have the right to withdraw your consent at any time in writing to our contact details mentioned in this Policy, or by following any relevant process to withdraw your consent (i.e., unsubscribing from marketing by clicking the “unsubscribe button” on the marketing emails you receive or by changing your preferences from your account you have with us after logging in it or through our support channels). Withdrawal of your consent does not affect the lawfulness of the treatment of your data prior to its revocation.

Companies that provide services on our behalf

We share your personal information with external organizations that carry out a range of services on behalf of SlotsMagic. We carry out checks to ensure that the companies we work with will give your information the same level of care and protection as we do. Both we and they are obliged to handle your information in accordance with the privacy laws and regulations, and we are also required to put in place contractual measures reinforcing those obligations – signing Data Processing Agreements (DPAs) with them. Please note that data processing may take place outside of Ontario and if it does, the processing will take place within an EU Member state. In those cases, the data is subject to the General Data Protection Regulation (GDPR) of Europe. There are cases where your data is transferred to third countries (i.e., USA) and for these cases all necessary measures for safeguarding your data and privacy rights are implemented. Information demands from Regulators:

On a regular basis, in all licensed jurisdictions, we are regulatory required to produce reports containing non-Personal Data. The reports consist of things such as the number of self-exclusions, number of registrations, number of complaints, and number of suspicious transactions reported to authorities.

Other information sharing with third parties:

We may also share personal data with selected third parties to measure and improve customer experience, to circulate new offers and promotions that may be of interest on various similar third parties’ products/services and to facilitate the resolution of customers’ complaints and disputes. This sharing takes place under a suitable legal authority for the disclosure of your data with third parties.

We may also process your personal data for the purposes of any future acquisitions, sales, restructuring or other business or asset disposals or transfers of any part of our business from time to time. This may include sharing your personal data with third party prospective purchasers, bidders, investors, professional advisors and other relevant people in respect of the transaction. Where this is the case, you will receive notice of any such transfer before it takes place, along with further details about how your personal data will be processed at the relevant time.

When we share your personal data with third party service providers, we only disclose to them the information that is necessary for them to provide their service and we have an agreement in place with them, requiring them to secure your information and use it in accordance with our instructions.

Transfers of data outside of Ontario/Canada

We will only transfer your personal data outside of Ontario / Canada, under certain conditions:

When it is necessary to fulfil a contract, you have entered with us.

When there is legitimate interest for our Company (i.e., fraud prevention), given that your rights and interests are respected and not overridden by our legitimate interest.

How long do we keep your information?

We hold your personal information only as long as we have a valid legal reason to do so, which includes providing you with the services you have requested, meeting our legal and regulatory obligations including as required by iGO policies and our operating agreement with iGO, resolving disputes and enforcing our agreements.

The length of time for which we keep different types of personal information can vary, depending on why we originally obtained them, the reason we process them and the legal requirements that apply to them. When setting our data retention and deletion timescales we consider a range of factors, including applicable regulations and standards relating to IGO policies and our operating agreement with IGO, gambling and gaming, anti-money laundering, taxation, payment processing and complaint handling, the need to prevent or detect crime or other misuse of our services, and audit requirements. To fulfil our requirements, some of your personal data will need to be retained for a period after you cease to be a customer. When we no longer need it to fulfil the above requirements, we delete it securely or anonymize it in accordance with the applicable retention policy and schedule. With the data obtained for marketing purposes, we will retain it until you withdraw your consent.

You hereby acknowledge that how you use the Software is outside of our control. We shall not be liable to you or to any third party in respect of your receipt of and/or use of the Software.

5. Real Money Mode and Practice Mode

By using the services offered through our Site, you will be able to play in either the 'Real Money'mode or 'Practice'
In 'Real Money'mode, real money may be wagered and gained. In order to play in 'Real Money' mode you will be required to have funds in your bonus balance, or pay funds into your account by any of the methods specified from time to time by Us. Should you become aware of any unauthorized use of Your Account, you are obliged to immediately notify us and we will suspend your Account pending further investigation of such unauthorized use. If you are using a shared computer, we advise that the checkbox to remember password is kept unchecked at all times.
In the event you have a Bonus Account and you have failed to make a deposit in 30 days from the time the Account was initially created, any Real Money/Bonus funds you had within the Account will be null and void, removed from the Account without any option to retrieve it.
Account facilities are provided to You solely to enable you to place bets or participate in games. You hereby confirm that You have not held a Player Account with Us that was terminated or suspended, and You have not notified Us, now or in the past, that You have a gambling addiction.
You hereby confirm that you will not intentionally disconnect from any Game while using the Our services. If We determine, in Our sole discretion, that You are in breach of this clause, We may terminate Your access to our Services immediately and/or have Your account blocked. If Your account is terminated or blocked in such circumstances, We are under no obligation to refund You any funds that may be in Your Account.
You hereby confirm that You shall not be involved in any fraudulent, collusive, fixing or other unlawful activity in relation to Your or third parties' participation in any of the Games.
You agree that if, in Our opinion, if any suspicious, improper, fraudulent, or unlawful activities are attempted and/or performed through the use of Our Services, We will be entitled to terminate and/or block your account and seize all funds available through that account.
In the event that you become aware that another user of Our services is cheating, manipulating or attempting to manipulate game outcomes and results, colluding with any other person in order to defraud Us, using Artificial Intelligence Software, or doing anything which can be construed as detrimental to us, financial or otherwise, You are responsible for sharing such information with us. We will treat any such information You pass to Us in the strictest of confidence. In the event that we discover, or suspect, that you had such knowledge and did not pass it on to Us, we reserve the right to terminate Our services to You and confiscate any funds which are in Your account.
Upon request from the Registrar (AGCO) to deactivate a player's account, we are bound by the conditions set forth in our license agreement to undertake all necessary measures to comply with such request.

7. Transactions: Deposits

All financial transactions will show up in your payment method statement.
After depositing, you will receive email confirmation of the transaction. We recommend that you print out and keeps details of all transaction data in order to avoid misconceptions and discussions at a later time.
i. Please note that credit card processors, at their discretion, may process transactions without using the CVV information for security verification.
All deposits will be effective immediately as soon as we get a successful confirmation from the selected payment processor. After depositing, you will be able to play immediately in Real Money Mode.
If our services to verify that the payment method used belongs to you detects that it does not, your account will be terminated.

If there are winnings accrued from deposits, we learn were made with a third-party payment method they will be voided. If the funds deposited using a third-party method are not fully spent, they will be returned only to the individual the payment method belongs to via a bank transfer. No refunds will be given for money spent after a deposit with a third-party payment method Following the registration of the account, the third-party should contact our support department with the details of you username/information to locate your account in order for us to continue the process.
No charge-backs can be made or initiated by you. In addition, payments including deposits made to your Account using any payment method/source cannot be renounced, cancelled, disputed for no valid reason or otherwise reversed. If this happens we reserve the right to take any of the following actions or request you to take immediate action, whichever the case may be, as a necessary measure to safeguard us against possible fraudulent activity or any other form of abuse:
1. You shall immediately and without undue delay refund the total amount due to us and compensate Us for any and all unpaid amounts due to us including any expenses or charges We might incur in the process of recovering the amount due;
2. Should you initiate a chargeback, we reserve the right to close your Account, initiate legal proceedings to recover the funds you are trying to chargeback as well as any charges or expenses which we might incur as a result and report the matter to the Police if we suspect foul play;
3. We reserve the right to recuperate the total amount due to us from your Real Money Account balance.
  
  Provided that in any case and for any of the above reasons, we reserve the right to cancel your Account at any time without any prior notification.
We may, at any time, set off any positive balance on your Account, or connected Account, against any amounts owed by you to Us.
In the case that there is a processing charge for your deposit you will be clearly informed about it during the deposit process.

8. Transactions: Withdrawals

Withdrawals will only be processed if you have a Real Money Account, (i.e. made at least one successful deposit). In accordance with Clause 1.18, in order to comply with Anti-Money Laundering regulations, it may be necessary for you to upload KYC documentation prior to withdrawing, for example:
1. Identity
2. Proof of Address, and
3. Proof of Ownership of the payment method used to deposit or withdrawal funds.

10. Malfunctions

If a technical problem causes a game/feature/promotion to pay out (or a display issue causes wrong result to be displayed) a higher amount than should be paid (a game win, bonus game win, jackpot win etc) to a player's Account, We reserve the right to remove all funds from the Account that were incorrectly credited as well as any winnings subsequently won by using the incorrectly credited funds
If We detect you are or have been abusing a technical glitch related to the games/software, either on your own or in association with partners, We reserve the right to void any winnings and close the relevant player/s Accounts.
In the event of a system malfunction all wagers shall be void.
In the event a game is started but miscarries because of a failure of the system, We shall refund the amount wagered in the game to You by crediting it to the Your Account or, if the account no longer exists, by paying it to You in an approved manner.
We shall take all reasonable steps to ensure that Our system enables Your participation in a game is, after You have made a wager, interrupted by a failure of the telecommunications system or a failure of Your computer system that prevents You from continuing the game, to resume, on the restoration of the system, your participation in the game that was interrupted as at the time immediately before the interruption. If Our system does not enable You to continue, after the restoration of the system, with a game interrupted by a failure of the telecommunications system or Your computer system, We shall:

1. ensure that the game is terminated; and
2. refund the amount of the wager to You by placing it in the Your Account.

11. Services Suspension

We may temporarily suspend the whole or any part of the Services for any reason at our sole discretion. We may, but shall not be obliged to, give you as much notice as is reasonably practicable of such suspension. We will restore the Service, as soon as is reasonably practicable, after such temporary suspension.

12. Change

We reserve the right to suspend, modify, remove or add content to the Site at Our sole discretion with immediate effect and without notice. We shall not be liable to you for any loss suffered as a result of any such changes made and you shall have no claims against Us in such regard.
Material changes in these terms and conditions, privacy policy or bonus policy will be communicated to You prior to them coming into effect.

13. Currencies

By default, when your account is created it will be in CAD.

14. Artificial Intelligence Software

You agree not to use any artificial intelligence software ('AI software') while using the software and/or Site. We will act to detect and prevent the use of any AI software programs that enables you to have an unfair advantage over other players, including, but not limited to, detecting the running of such programs on your computer. In the event that we detect the use of AI software, and at our sole discretion deem the detection to be valid, your Account will be terminated, and all winnings cancelled.

15. Random Number Generator

You accept and agree that a random number generator will determine the randomly generated events required in connection with the Services and where the result shown on the Software (as installed and operated by your hardware) conflicts with the result shown on our, or our game partners servers, the result shown on our server shall in all circumstances take precedence. You understand and agree that (without prejudice to your other rights and remedies) the Company records shall be the final authority in determining the terms of your use of the Services and you shall have no right to dispute the Company's decisions in regard to such matters.

16. Abusive or Offensive Language

We will not tolerate any abusive or offensive language or other behaviour considered inappropriate by Us at our sole discretion.
Bad behaviour or language identified by Us or brought to Our attention may result in a suspension or loss of playing privileges or such other action as may be decided by Us, including, but not limited to, Account closure.
It is forbidden for players to use offensive Usernames or Screennames when they register or login.
Players may, at any time, submit information regarding abuse or other offences to our Customer Support Department for Us to investigate.

17. Monitoring of the Site

We may electronically monitor the Site and the users of the Site at any time in order to ensure compliance with this Agreement and may disclose any information, record or electronic communication of a user of the Site: (a) in compliance with any law, regulation or lawful governmental request; (b) if such disclosure is necessary for the continued operation of the Site; or (c) to protect Our rights and/or property of Our partners.

18. Inactive Accounts

Your account will be deemed to be inactive if you have not accessed your account for 6 consecutive months. In the event that your account becomes inactive, we reserve the right to charge a fee of 5 CAD per month until the account becomes active again.
In the event of a fee being charged, the fee amount shall be deducted from your remaining balance. Should your account balance be insufficient to cover the fee, the remaining balance shall be fully depleted and your account balance will be reset to zero. If your account balance is already zero, no fee shall be charged.
We will take reasonable steps to contact you via email 30 days prior to the fee being charged. We reserve the right to waive or reduce the fee at our sole discretion. If you wish to reactivate your account, you may do so by logging in.
VIP points must be converted within 180 days of them being granted, otherwise they will be removed.
Players may recover funds from their inactive accounts by logging in and making a withdrawal request. In case of blocked and excluded accounts, players will need to contact Customer Support to recover funds.

19. Incomplete Games

If you lose internet connection or abandon a game before it is complete (for example during a special mode in Slots, or during a hand in single player Blackjack) you will be able to complete the game by logging back in and opening the relevant game. If you do not di this within 14 days the game will be closed and any bet will not be returned and any potential winnings will be forfeited.

20. Dormant Accounts

27. Account Termination and Suspension

29. Governing Law

30. Limitation of Liability

In this event our total aggregate liability shall not exceed the amount of the wagers you placed via your Account in respect of the wager that gave rise to the relevant liability or the actual amount misplaced in your Account where such amount has been misplaced by us due to a system failure, whichever the case may be.

31. Indemnifications

33. Severability
